The State Duma will develop a bill to ban the punishment of drivers for the use of a number of drugs
Moscow, November 30, 2022, 09:42 — REGNUM The State Duma deputies from the LDPR intend to enshrine in law the decision of the Constitutional Court on the deprivation of the right to drive a vehicle in cases where traces of drugs that are not psychotropic or narcotic are found in the driver’s body. According to the correspondent IA REGNUM November 30, this was announced by the deputy head of the faction Yaroslav Nilov.
“In the near future, we will consolidate the court-imposed ban on deprivation of the right to drive a vehicle in cases where traces of drugs that are not related to psychotropic or narcotic drugs are found in the driver’s body. For this, the LDPR faction will prepare and introduce the necessary amendments to the Code of Administrative Offenses, ”Nilov said.
At the same time, according to the parliamentarian, the amendments should have retroactive effect – “in order to return the rights to all those who have lost them in connection with this drug conflict.”
The Constitutional Court ordered the State Duma to “immediately” amend the Code of Administrative Offenses and come up with a mechanism for punishing drivers who abuse drugs that cause intoxication and the effect of intoxication. The court forbade courts to deprive drivers of their rights and impose a fine of 30,000 rubles on them if traces of drugs other than psychotropic or narcotic drugs were found in their bodies.
Earlier, the State Duma proposed labeling drugs that are prohibited for drivers to use while driving. The parliamentarians were sure that the special warning sign on the packaging of the drug and the period during which it is not recommended to drive was enough for responsible drivers. However, the initiative did not find support in the Russian government.
At the same time, we would like to note that, traditionally, draft laws are submitted to the State Duma by the Russian government in pursuance of the decision of the Constitutional Court.
