Today, in the lower house of parliament, in the third reading, a law was adopted to introduce criminal liability for beatings committed for the third or more times by a person who has a criminal record for similar violations. In accordance with the new amendments to the Criminal Code, the attacker will face either compulsory labor (up to 480 hours), or correctional labor (up to one year), or restriction of freedom (up to one year), or arrest (up to 6 months).
“That is, a person with an unexpunged conviction in a new case of beatings will again be brought to administrative responsibility. The draft law eliminates the contradictions in the current legislation identified by the Constitutional Court of the Russian Federation,” Deputy Pavel Krasheninnikov noted the vulnerability of existing legislative norms, in connection with which liability was toughened.
“Article 116.1 of the Criminal Code of the Russian Federation is supplemented with part two, which provides for liability for beatings or other violent acts that caused physical pain, but did not lead to health problems, that is, the consequences specified in Article 115 of the Criminal Code ”Intentional infliction of minor bodily harm”” , — the mechanism of action of the new law in press releasepublished on the website of the State Duma.
The bill was registered in Parliament in October 2021. The mentioned article 116.1 of the Criminal Code of the Russian Federation is applied in cases of domestic violence. Previously, the Constitutional Court considered it inconsistent with the Constitution, since it did not provide for more severe punishment for recidivism.
