Now the owners of apartment buildings can keep funds for overhaul in the general piggy bank of the regoperator or on a special account. In the second case, rubles are not always spent rationally. To change the situation, the Ministry of Construction suggested that Goszhilnadzor maintain a register of minutes of the general meeting. There is also a requirement for tenants using a special account to monitor the result of repairs and place certificates of acceptance of work in the GIS Housing and Public Utilities. Such initiatives are contained in the draft amendments to the Housing Code, published on the portal of draft regulatory legal acts.

Responsible and not so

The problem of using special accounts has been discussed for a long time. On the one hand, there are active and responsible residents who find repair companies with an adequate price-quality ratio. On the other hand, there are cases of unfair use of savings when workers are hired without the necessary qualifications. And then you can not wait for a good result.

So back in 2022 Vladimir Putin instructed to strengthen the role of the housing inspectorate in monitoring the activities of managing organizations in MKD, where special accounts are used. Fulfilling the order of the president, the Ministry of Construction prepared a draft law, where he proposed that the owners carry out construction control of overhaul works, and then place the acts of this inspection in the GIS housing and communal services.

According to the Deputy Chairman of the State Duma Committee on Construction and Housing and Public Utilities Svetlana Razvorotneva, many agree that such control is necessary. “Now you can enter into a contract on any basis with any supplier, no matter if they are included in the register of qualified contractors or not. And then it is not clear who controls and accepts the work and what comes out in the end, ”the deputy is perplexed. Therefore, she considers the document of the Ministry of Construction positive. It is necessary to oblige the owners of special accounts to conclude an agreement with a consolidated organization, Razvorotneva is convinced, and this may be one of the steps.

And the chairman of the State Duma Committee on construction and housing and communal services Sergey Pakhomov believes that the owners, when deciding to accumulate their funds on special accounts and spend them on their own, are jointly and severally liable for the performance of work and their order. “This is their money, their decision, and you don’t need to help them with this. But where we should help is in the issue of monitoring the implementation and quality of the work carried out. Such help will certainly not be superfluous. Naturally, without unnecessary bureaucratization of processes. We have already given all the necessary tools at the legislative level for this and are ready to finalize the decisions if necessary, ”the politician emphasized.

And about protocols

The bodies of state housing supervision, as stated in the explanatory note to the document, will be obliged to “keep a register of minutes of the general meeting of owners of MKD regarding the decision to carry out work on the overhaul of common property.”

“Forgery of protocols is a big problem, and in this case it also leads to the fact that homeowners with special accounts, when they do not have enough money for major repairs, cannot get a loan with low interest rates. Because banks are not sure that people at the meeting really voted for carrying out certain types of work, ”explained Svetlana Razvorotneva. She suggested that this change would help resolve the issue.

Sergei Pakhomov noted that the logic of the Ministry of Construction’s initiatives is clear – to concentrate legally relevant information as much as possible with one responsible state body. “In general, this idea is correct. But as far as the functions of the state housing inspectorate are concerned, it must be distanced from administrative and administrative functions: protocols, registers and related administrative decisions. Because in the form in which the organization is now functioning, this is not the best body for such work, ”the parliamentarian explained. But he supported the expansion of the possibilities of the state housing inspectorate in checking the quality of overhaul works, including the activities of regional operators.

Advantages and disadvantages

Recall that people can raise money for the overhaul of their home in two ways. The first is on the general account of the regional operator, where contributions from most of the apartment buildings are collected. Then the overhaul in the house will be carried out according to the schedule approved by the regional government. At the same time, the overhaul fund prepares the assignment for the performance of work and project documentation. It is also his duty to search for contractors, conclude contracts with them and pay for their services. And residents only participate in checking the quality of work. These are all the advantages of this option, and the disadvantage is that the repair itself can be expected for a very long time.

If you want to update shared housing as soon as possible, then there is another way – to open a special account for a particular house. Such a decision can only be made at a general meeting of owners. It is important to set the amount of the monthly overhaul premium and choose the owner of the savings. It can be a homeowners association, a housing cooperative, a managing organization, and even a regional operator that will keep trusted banknotes separately from the common money box. The minutes of the meeting must be sent to the overhaul fund. Then, within six months, the already accumulated money of this house will be transferred from the general to a special account.

The tenants will again dispose of their stocks by decision of the general meeting of owners. For example, replace the sewer risers throughout the house, repair the elevator or shaft, roof or basement, patch up the facade or foundation. From the same funds, you will have to pay for the development of project documentation for overhaul or construction control services. If there is not enough finance, then you will either have to save further or take a loan.
