Individual entrepreneur from Perm Alexander Kenin became a defendant in court in a lawsuit filed by the military registration and enlistment office of the Perm region. The case was considered by the regional Arbitration Court. Kenin will have to pay a penalty for improperly providing the service of transporting conscripts, according to the ruling on the court’s website.
“To recover from individual entrepreneur Alexander Vladimirovich Kenin in favor of the FKU “Military Commissariat of the Perm Region” unjust enrichment in the amount of 39,127 rubles. 50 kopecks, a fine in the total amount of 132,040 rubles,” the definition says. As follows from the court ruling, government contracts were concluded between the military registration and enlistment office and the entrepreneur in 2019-20 “for the provision of transport services for the transportation of citizens called up for military service.”
In accordance with the contracts, Kenin was required to provide technically sound vehicles no older than 2009 for transporting conscripts to a collection point located on Dokuchaev Street in Perm. However, the customer identified hundreds of violations during the execution of contracts and demanded that Alexander Kenin pay a fine and penalty in the amount of almost 3.5 million rubles.
The court, considering the claim, pointed out the “clear disproportionality of the penalties.” “The specific circumstances of the case, the terms of State Contracts, the provision of services by the contractor in full and the absence of negative consequences” were taken into account.” As a result, the amount of the fine was reduced by the court by 26.5 times.
