The head of the Ministry of Justice considers it necessary one day to resolve the issue of the ban on ideology in the Constitution

The Minister of Justice of Russia Konstantin Chuichenko announced the need to resolve the issue with the provision of the Constitution on the prohibition of state ideology (part 2 of article 13 of the Constitution of the Russian Federation). He said this during a discussion at the session “Children of Donbass: the right to protection” at the XI St. Petersburg International Legal Forum.

“Of course, we will have to resolve the issue with the article of the Constitution of the Russian Federation, which states that we have neither a state nor a mandatory ideology,” said the head of the Ministry of Justice (quoted by TASS).

As Mr. Chuichenko explained, the article on the prohibition of state ideology replaced the 6th article of the USSR Constitution – “The guiding and guiding force of Soviet society, the core of its political system, state and public organizations is the Communist Party of the Soviet Union. The CPSU exists for the people and serves the people.”

In this regard, the head of the Ministry of Justice believes, the introduction of a ban on ideology is partially justified. “It is clear that, in principle, no country in the world has such provisions in its constitutions. Only Russia at one time, on the advice of our so-called partners, assumed these “increased obligations,” said Konstantin Chuichenko.

According to the 13th article of the Constitution, in Russia “ideological diversity is recognized” (part 1), “no ideology can be established as a state one” (part 2), “political diversity” is recognized in the country (part 3), “ public associations are equal before the law” (part 4).

Article 13 is included in the first chapter of the Constitution “Fundamentals of the Constitutional Order”. According to Article 135, in order to revise the first, second and ninth chapters, the Constitutional Assembly must decide on the development of a new draft Constitution. These chapters cannot be revised by the Federal Assembly.
