The government supported the proposal to strengthen the administrative responsibility for the transfer of mobile communications to places of deprivation of liberty. This was reported in Telegram channel the author of the initiative is Alexander Khinshtein, head of the State Duma Committee on Information Policy.

According to him, a new special part will appear in the current version of the article of the Code of Administrative Offenses on the transfer of prohibited items to persons held in penitentiary institutions or temporary detention facilities.

“Earlier, the government and the Supreme Court also gave positive feedback to my bill on criminal liability for the re-transfer of communications equipment to penitentiary institutions,” Khinshtein recalled.

He emphasized that the problem needs to be solved comprehensively. If the violator is caught while transferring a mobile phone and components to jail, he will face administrative liability, and the expected sanction will be from 25 to 50 thousand rubles fine.

If this happens again, the person will face criminal liability: either a fine in the amount of 100 to 300 thousand rubles, or imprisonment for up to two years. This is a new projected article 321.1 of the Criminal Code of the Russian Federation, Khinshtein specified.

The MP added that he expects that in the near future the initiatives will be submitted for consideration by the lower house of parliament.

Currently, the maximum penalty for transferring phones to detention centers and prisons is a fine of five thousand rubles.
