The decision to demolish the squatter will be taken by the authorities of municipal districts

Local self-government bodies of municipal districts received more powers in making decisions about the fate of unauthorized buildings. Such a law dated April 14, 2023 No. 121-FZ enters into force on April 25.

The document, developed by the government, provides for changes to the Civil Code of the Russian Federation. As the Deputy Head of the Ministry of Construction noted earlier Svetlana Ivanova, new norms were needed in connection with the adoption of the law on the emergence of municipal districts in Russia. They may include a territory that unites several settlements. These districts, created in 2019, have virtually the same powers as urban districts.

Now the authorities of municipal districts will be able to decide whether it is necessary to demolish unauthorized structures on land plots for which there are no title documents. They also have the right to force the demolition of buildings erected on a site where it is not allowed to build such an object and which is located on a common area. At the same time, the municipal district may ask the owner of the building to reconstruct it, bringing it into line with the requirements of the law.

Also, the new law establishes that escheated property can pass into the ownership of the municipal district in the order of inheritance.
