The Tyumen Regional Court overturned the sentence for the “black realtor” Svetlana Spicheva, who was convicted of fraud. The information is presented in the judicial act. The woman deceived Tyumen residents out of more than 12.9 million rubles.
“The verdict of the Kalininsky District Court of Tyumen regarding Svetlana Arkadyevna Spicheva is cancelled. Refer the case for a new trial,” says the decision of the Tyumen Regional Court.
The woman was convicted of multiple counts of fraud. As the prosecutor’s office of the Tyumen region previously reported, a 57-year-old realtor deprived people of their apartments, earning more than 12.9 million rubles. She invited homeowners to participate in the cash-out scheme, but promised that home purchase transactions would be formal, and they would get their apartments back. However, then she sold the house and kept the money for herself.
In an appeal against her sentence (the woman was sentenced to 8.5 years in prison), Spicheva demanded a reduction in the punishment and noted that the court did not take into account mitigating circumstances. Namely: the state of her health, the fact that her son is in the SVO, and her daughter is a single mother with three children. In addition, according to the woman, her lawyer did a poor job, and the court did not take measures to replace him, which deprived the woman of the right to defense enshrined in the Constitution of the Russian Federation.
As a result, the verdict was overturned. Now the court of first instance will again consider the case and issue a new verdict on it.
