Russia wants to temporarily simplify the conclusion of concession agreements

The government is offered to be given the opportunity to establish cases in which concession agreements in the regions can be concluded without a tender. Such a bill (No. 135977-8) was adopted by the State Duma in the first reading on June 14.

According to the first deputy head of the Ministry of Economic Development, Ilya Torosov, the bill is aimed at developing the mechanism of concession agreements. In particular, they want to allow the conclusion of concession agreements in the regions without competition. “This allows us to speed up the conclusion of concession agreements at the regional level, to reduce it by about six months,” Torosov explained.

The project was developed in pursuance of a plan of priority actions for the development of the Russian economy in the face of external sanctions pressure. The government is proposed to be given the right to establish cases in which regions can conclude concessions without competition. This rule is temporary and will be in effect until the end of 2022. The bill will not affect concession agreements for housing and communal services and infrastructure facilities for passenger transportation.

Also adopted on first reading bill (No. 136325-8), proposing to allow revision of the essential terms of concessions in 2022 without approval from the Federal Antimonopoly Service. These norms were developed in connection with the rise in prices for building materials, Ilya Torosov noted. At the same time, the revision of the terms of the agreements should not lead to an increase in tariffs for the population and a decrease in planned investments. The proposed norms will not affect agreements on housing and communal services and municipal solid waste.
