
Head of Legal Practice at SuperJob Alexander Yuzhalin said that the company has no right to refuse a planned vacation.
“The company does not have the right to refuse vacation, since the vacation schedule is mandatory for both the employee and the employer under Article 123 of the Labor Code,” reported RIA Novosti lawyer.
Yuzhalin added that the employer can ask the employee to postpone the vacation to another period. In the event that the employee is against the postponement of the leave, it must be provided.
Sometimes there are reverse situations when an employee asks management to postpone the vacation for a period convenient for him. In this case, everything depends on the company, the lawyer noted.
The company does not have the right to refuse employees who have the right to use vacation at a convenient time, even if a different period is indicated in the schedule, the specialist concluded.
