Kurgan equity holder sued more than 600 thousand rubles from a developer from Moscow

The Moscow developer SZ Staroselye will pay equity holders from Kurgan more than 600 thousand rubles for the broken deadline for the transfer of the apartment and the identified construction defects. Relevant information is published on the website of the city court.

“To collect from OOO Specialized Developer Staroselye in favor of the plaintiff a penalty in the amount of 400,000 rubles. The fine for non-compliance with the voluntary satisfaction of the requirements of the consumer is 207,500 rubles, as compensation for non-pecuniary damage – 15,000 rubles, ”the court decision states. Initially, the shareholder demanded more than 1.4 million rubles from the company Specialized Developer Staroselye. The court granted this requirement in part.

According to the contract, the developer was supposed to hand over the object to equity holders no later than August 1, 2021, however, the plaintiff and his wife did not receive a two-room apartment with an area of more than 47 square meters in due time. Since then, the construction company has extended the deadline twice. The last time it was due to the fact that the developer had to eliminate the shortcomings of the construction.

Earlier URA.RU wrote that the Kurgan equity holder sued half a million rubles from a developer from Moscow. The court ordered to recover from the construction company 571 thousand rubles for defects that were discovered during the delivery of the apartment.
