In Tyumen, the owners sued a 4-room apartment from the city administration

The Association of Property Owners has seized a four-room apartment from the Tyumen administration. The housing was on the balance sheet of TSN Chervishevsky for more than 15 years; on September 27, the decision of the Arbitration Court was handed to the plaintiffs. The chairman of the partnership, Natalya Polyakova, told URA.RU about this.

“It was a whole epic. The apartment was allocated as a change house during construction, the owners paid for its maintenance for more than 15 years, then decided to sue to transfer it to the ownership of the partnership. We won the case,” Natalya Polyakova told URA.RU.

The Arbitration Court of the Tyumen Region considered the claim for four months; the Tyumen administration acted as the defendant in the court. The court sided with the owners and found that the plaintiff has openly, bona fidely and continuously owned it for more than twenty years in a row, bears the burden of its maintenance and, accordingly, has the right to acquire the above property by virtue of acquisitive prescription.

“Recognize the ownership rights of the Chervishevsky Real Estate Owners Association by virtue of acquisitive prescription for an apartment with a total area of ​​72.9 square meters. m.,” is stated in the decision of the arbitration court. The decision entered into legal force and was not challenged by the Tyumen administration.
