In Tyumen, for the first time in Russia, a couple divorced, one of the spouses in which changed sex

A court in Tyumen invalidated the marriage of a couple in which one of the spouses changed sex. This was reported to URA.RU by the lawyer of the Tyumentsev Pavel Rusnakov. According to him, such a precedent in Russia occurred for the first time.

“The claims of the prosecutor’s office to recognize the marriage of my principals as invalid were satisfied. This is the first such case in Russia, there have never been such decisions (when the reason for the dissolution of the marriage was the change of the sex of one of the spouses – approx. URA.RU),” lawyer Pavel Rusnakov told URA.RU.

According to the lawyer, there is no legislation in the Russian Federation that would regulate this situation, there were no grounds for satisfying the claim. Whether the Tyumen residents will appeal the court’s decision is still unknown.

Residents of Tyumen got married in 2019. However, later one of the spouses (husband) decided to change sex, in September 2022 this fact was officially registered. After that, the prosecutor of Tyumen, Vladimir Bondarchuk, filed a lawsuit in which the department demanded that the marriage be declared invalid, because according to the Constitution of the Russian Federation, marriage is the union of a man and a woman. The corresponding amendment to the main law of the country was made in 2020.
