Business offered to exempt from fines for the sale of gadgets without Russian software

The Ministry of Digital Development proposed to release businesses from administrative responsibility for the sale of certain types of technically complex goods without pre-installed Russian software. The ministry submitted such a bill to the Government, RIA Novosti was told in the press service of the Ministry of Digital Development.

The draft law provides for amendments to Article 14.8 of the RF Code of Administrative Offenses (CAO). It is assumed that the exception will operate in accordance with the rules legalizing parallel imports. The project has been approved by the interested federal executive authorities.

“The bill provides for exemption from administrative liability for the sale of certain types of technically complex goods (smartphones, tablets, computers and TVs with a digital control unit) included in the list of the Russian Ministry of Industry and Trade for parallel imports without installed Russian programs,” the press service told the agency. ministries.

It explained that with parallel imports, it is impossible to pre-install the mandatory Russian software.

The law on the pre-installation of domestic software was adopted in November 2019. In accordance with it, manufacturers are required to install programs of domestic developers on their equipment. This can be done in three ways: immediately install the application or software on the hard drive, place icons for free download, or enter a special dialog box when activating the device, with which the consumer will download the software of his choice.

Since July 1, 2021, fines have been introduced for violations of the requirement to pre-install Russian software: for officials – in the amount of 30 thousand to 50 thousand rubles, and for companies – from 50 thousand to 200 thousand rubles.
